Dispute resolution procedures

ICE publishes procedures for the five main forms of dispute resolution currently used in the construction industry.

Adjudication Procedure

Adjudication is the most common form of dispute resolution in the UK and is growing internationally. ICE provides a robust and structured procedure in line with current best practice and statutory requirements.

Arbitration Procedure

Offering a viable alternative to adjudication, the ICE arbitration procedure offers three options that are selected according to the value of the dispute. This allows parties to get a final and binding decision on disputes where it would normally not be financially viable to settle using traditional arbitration.

Construction Mediation Procedure

Mediation allows the parties in dispute to explore ways of settling with the assistance of an impartial mediator. Mediation is an assisted negotiation and as it is a voluntary process is available to parties in dispute, at any time, regardless of the statutory right to adjudication.
